Draft for lawyer review. This policy is a plain-English template and should be reviewed by a qualified lawyer before it's relied on.
Privacy policy
This policy explains how Proud Creative Pty Ltd (ABN 28 677 481 953) of 81–83 Campbell Street, Surry Hills NSW 2010, Australia ("Proud", "we", "us") handles personal information collected through this website and our landing page service.
1. The law we follow
We handle personal information in line with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). If you're in the United States, see section 11 for extra information, including for California residents.
2. What we collect
When you book through our form, we collect:
- your name, email address, phone number and company or brand name;
- your Shopify store URL, ad spend and channels, and the offers you want pages for;
- your chosen build date;
- your e-signature record when you sign our service agreement: your typed name, your drawn signature, the time you signed, your IP address, your browser's user agent, and the agreement version.
We also receive basic technical data (such as IP address and browser type) in our hosting provider's server logs.
3. Payments
Payments are processed by Stripe. Your card details go directly to Stripe and are never stored by Proud. Stripe sends us a payment confirmation and limited details such as your name, email and the amount paid. Stripe's own privacy policy applies to the data it handles.
4. Your Shopify store
To build your pages you give us collaborator access to your Shopify store. We use that access only to do the work. We may be able to see store data, including customer and order information, but we don't export, sell or use it for anything else. You can remove our access at any time once the work is done.
5. Why we use your information
- to confirm your booking, take payment and deliver the service;
- to keep a record of the agreement you signed;
- to contact you about your project and the 30-day review;
- to run, secure and improve this website; and
- to meet our legal, tax and accounting obligations.
We don't sell your personal information, and we don't use it for unrelated marketing without your consent.
6. Where your data is stored, and overseas disclosure
This website is hosted by Vercel, and booking and signature records are stored in a database run by Neon. Both are in the United States. Stripe may also process data overseas. That means your information is disclosed to, and stored by, providers outside Australia. We pick reputable providers and take reasonable steps to make sure they protect your information in a way consistent with the APPs.
7. Cookies and browser storage
The booking form saves your progress in your browser's localStorage, so you don't lose your answers if you leave and come back. That data stays on your device until you clear it. We don't use advertising or tracking cookies. If we add analytics or ad pixels later, we'll update this policy first. Stripe's checkout may set its own cookies for fraud prevention.
8. How long we keep it
We keep booking, payment and signature records for as long as we need them to deliver the service and meet our legal obligations. That's generally 7 years for financial and contract records. After that we delete or de-identify them.
9. Security
We use encrypted (HTTPS) connections, access controls and reputable providers to protect your information. No system is completely secure, but we take reasonable steps to protect your information from misuse, loss and unauthorised access.
10. Access, correction and complaints
You can ask to see or correct the personal information we hold about you by emailing sam@proudaspunch.studio. We'll reply within 30 days. If you have a privacy complaint, email us first and we'll try to resolve it. If you're not happy with our response, you can complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
11. US visitors, including California
If you're in the US, we handle your information as described above. Depending on where you live (for example, California under the CCPA/CPRA), you may have the right to know what personal information we collect, ask us to delete or correct it, and not be treated differently for using these rights. We don't sell or "share" personal information for cross-context behavioural advertising. To make a request, email sam@proudaspunch.studio. We may need to verify your identity first.
12. Changes
We may update this policy from time to time. We'll post the new version here with a new effective date.
